TERMS OF THE CONTRACT
This contract contains all aspects of understanding between “THE COMPANY” and the Client. This supersedes any prior written or oral agreement between the parties. The only way to add to or change this agreement is in writing and signed by both parties.
If you do not accept these General Terms and Conditions, Additional Terms or otherwise we cannot provide you with the requested service.
RESERVATION: The signing of the contract and advance payment is required to reserve the specified event.
PRIOR CONSULTATION: The parties agree to meet in advance of the event to discuss some issues regarding the logistics of the photographs.
COOPERATION: The parties agree to have all cooperation and communication to achieve the best result of this work. They will be willing to accept suggestions from the Photographers for a particular shot which will show off the Photographer's own style.
DEDICATED TIME: The Photographer agrees to attend on the contracted and indicated date and time where the essence of the event will be covered. During the meeting or reception, they will be notified about the work done and it will be agreed if more shots are necessary to proceed with them or withdraw. of the event or if the contracted time has already expired and the client does not decide to continue with overtime, or if the client needs more overtime but at their event there is already a lot of disorder due to the guests and the alcohol may decide not to continue. with the requested overtime.
EVENT RULES: “THE COMPANY” will be limited to the rules of the event, the Church or the reception place, therefore the client accepts the technical results of the impositions or limitations that these have, which may be affected in terms of lighting. , quality, and differences in the final work. The participation of other photographers is not accepted by “THE COMPANY”, therefore, the client is responsible for ensuring that this does not happen, especially in the Church where photographers commonly appear who interfere with the shots, as well as, if the guests, when taking the shots do not interrupt or bother the work of “THE COMPANY”.
COPYRIGHT: All photographs taken during the events described above are the property of “THE COMPANY”.
Photographs purchased by the client (Copy) may be reproduced and displayed, exclusively for personal use.
RESPONSIBILITY AND SATISFACTION GUARANTEE: The client accepts the type or style of images created by “THE COMPANY” assuming having viewed works by “THE COMPANY” recent to the signing of this contract, which will resemble in environmental, human and location circumstances. those displayed.
If this is not the case, you accept that said different circumstances will result in different images and that this leaves “THE COMPANY” unable to create images such as those displayed by the client as a sample.
For this reason, we provide you with the Services "as is" and "as available or similar to the sample works that were shown to you before contracting the service," which due to various circumstances may be somewhat different, environment, rush, interruptions, bad coordination of the times of your event, places not suitable for shooting, interruption of guests, loss of data, etc., due to an endless number of conditions beyond “THE COMPANY” without any guarantee or condition, express or implied, except as is specifically set out in these General Terms and Conditions.
Due to an act of bad faith, clients tend to ensure that they do not like the final work, the total payment of this contract is not conditional on the client liking the final material, it is conditional on delivering the same quality that was previously shown to them. upon signing this contract.
We do not guarantee loss of data, audio files and other work materials, and many circumstances may cause any technical or human failure by others or by personnel of “THE COMPANY”, and we will not be responsible for any interruption or impairment of the Services in accordance with these Terms and general conditions.

If due to any circumstance of force majeure, accident, disability, or theft, the photographers could not fulfill this commitment, either before the event or after it, In the event that part or all of the photographic or video material obtained suffers technological damage, accidental loss or theft, the responsibility of “THE COMPANY” is limited to the partial or total refund of the money depending on the loss of the material in question, and the client will exclude “THE COMPANY” from all legal or juridical liability.
The Client agrees that in no event will we be liable for any of the following types of loss or damage arising in connection with these General Terms and Conditions, Additional Terms or otherwise:
a) indirect or consequential loss or damage (including loss of profits, goodwill, business, contracts, revenue or anticipated savings even if we are informed of the possibility of such damages),
b) loss or corruption of data,
c) loss or damage that does not arise directly from our violation of these General Terms and Conditions or any additional terms,
d) loss or damage exceeding that caused as a direct result of our breach of these general terms and conditions or any additional terms (whether or not you are able to prove such loss or damage).
e) loss or damage incurred by you as a result of any act or omission by you or any third party or our obligation to comply with applicable law, any act or omission of any governmental authority, act of war, accident, natural disaster, strike, blockade or other similar event, regardless of whether we are an instigator or subject of such event.
CANCELLATION POLICY: In the event of cancellation of the event, the advance payment will not be subject to a total or partial refund, remaining as compensation for damages, since the opportunity to sell the date to another client would be lost.
However, in the event of a date change, the photographer will attend as long as availability allows and is notified in advance.
DELIVERY OF THE MATERIAL INCLUDED. The contrary is not specified in the “OTHER” section of this contract, the delivery will be made in digital format (JPG) at maximum resolution without watermarks or signatures of the photographer, also including a summary of the selection that the photographer considers of some 200-400 photos, which are NOT delivered retouched.
DELIVERY TIMES FOR PHOTOGRAPHIC MATERIAL. The photographer undertakes to deliver the included material within 60 to 90 business days after the event.
METHOD OF PAYMENT: The client must cover the missing part of the payment of this contract one week before the event. Due to an act of bad faith, clients who do not settle their commitment tend to ensure that they do not like the final work, the total payment of This contract is not conditional on the client liking the final material, it is conditional on delivering the same quality that was shown to them prior to signing this contract.
CONTRACT RECEIPT:
We reserve the right to terminate this contract in the following cases:
a) Lack of payment on the agreed date, or any other breach by the client.
b) Attacks by guests or any person at the event, the staff will proceed to stop work by notifying the person in charge of the party or, whatever the case may be, such notice will not be necessary for the safety and integrity of the staff working at your event. .
c) Not respecting the contracted hours due to poor organization of the event.
For events in Apartments, the client must have the place ready where the equipment will be installed.
''THE COMPANY'' must also have a space assigned by the apartment administration for parking the vehicle of ''THE COMPANY'' in case the vehicle is lifted or collected by the tow truck, the costs of vehicle recovery and payments towing and storage of the vehicle will be the responsibility of the client who contracted the service. By signing the contract you are authorizing us to charge the expenses to your credit or debit card, we will use any other means to recover the damages caused, as well as any damage or loss of the Team in the event.
